General conditions for the provision of postal services

WORLD MEDIATRANS S.R.L., with registered office in Timisoara, blv Cetatii nr 5-7-9, jud. Timis, tax code 9480727, offers postal services for domestic mail under the following conditions:

WORLD MEDIATRANS S.R.L. accepts postal items presented by the sender, properly packaged, with an opaque outer wrapper that does not allow the contents to be visualized, and bearing the full identification data of the addressee, and in the case of the Cash on Delivery service and the Paper Postal Money Order service, and of the sender (name and surname/name in the case of legal entities, and full delivery address).

The sender is responsible for the packaging of the postal items and for the data on the postal item.

Mail items containing fragile goods must be properly packaged by the sender, using as padding, polystyrene or other material that attenuates mechanical shock, and marked “Fragile”. WORLD MEDIATRANS S.R.L. undertakes to recognize and respect the markings/labels affixed by the sender and to pay special attention in handling and storing the postal items in question.

Packaging already used/inscribed packaging will not be accepted.

The postal items must be enclosed by the sender in intact packaging (no cracks, tears) appropriate to the weight, shape and nature of the contents, as well as the mode and duration of transportation.

The packaging and sealing of the postal item must protect the contents in such a way that the contents cannot be damaged by pressure or tampering and cannot be mixed with the contents of other postal items, and that access to the contents is impossible without visible spoliation.

WORLD MEDIATRANS S.R.L. is not responsible for any alteration of the mailpiece by electromagnetic means or due to electromagnetic causes (e.g. demagnetization, X-ray scanning in security/cleaning procedures, etc.).

Maximum accepted dimensions of the postal item:
– 210 mm X 297 mm (A4 format) for envelopes;
– 50 cm X 70 cm X 120 cm for parcels.

The sum of the dimensions (L + W + H) of the parcel must not exceed 240 cm.

The maximum permitted weight of a postal item is 31.5 kg.

The volumetric weight is calculated by the formula: length x width x height (measured in centimeters) /5000.
WORLD MEDIATRANS SRL tariffs are applied in RON for the higher of the physical and volumetric weight (obtained using the volumetric conversion relation).

WORLD MEDIATRANS S.R.L. does not accept postal items whose packaging bears inscriptions contrary to public order or morality, as well as postal items consisting of goods contrary to public order or morality, if they are delivered unpackaged or in transparent packaging. Goods the transportation of which is prohibited by law, even for a part of the journey (for example, but not limited to: explosive, toxic, flammable, inflammable, psychotropic substances, drugs, weapons or parts thereof, ammunition, etc.), may not be the subject of postal items.

The sender is obliged not to introduce into the postal network postal items whose subject matter is prohibited by law.

WORLD MEDIATRANS S.R.L. ensures the secrecy of postal items – withholding, opening or disclosing the contents of postal items is permitted only under the conditions and with the procedure provided by law.

WORLD MEDIATRANS S.R.L. ensures delivery of domestic mail within 2-5 working days.

WORLD MEDIATRANS S.R.L. provides the registered mail service, the specific features of which consist in offering a flat-rate guarantee against the risks of loss, theft, total or partial destruction or damage of the registered mail item and in issuing, upon request, after the postal item has been deposited or delivered, a proof of the postal item’s deposit or delivery to the addressee, without written confirmation by the addressee.

The Consignor may request the issuance of the proof of deposit of the postal item or delivery to the addressee within 9 months from the date of its deposit in the WORLD MEDIATRANS S.R.L. network. The Supplier shall be obliged to send the proof of deposit or delivery to the Consignor within a maximum of 5 working days from the date of the request, by an agreed method (e.g. fax, e-mail, etc.), without any additional costs for the Consignor.

WORLD MEDIATRANS S.R.L. provides declared value mailing services, which consist in insuring a postal item against loss, theft, total or partial destruction or damage, for an amount not exceeding the value declared by the sender, and in issuing, upon request, a proof of deposit of the postal item.

The time limit within which the sender may request proof of deposit of the postal item subject to a declared value mailing service is 9 months from the date of its deposit, WORLD MEDIATRANS S.R.L. being obliged to communicate the proof of deposit within a maximum of 5 working days from the date of the request, by a method agreed with the sender or the integrator (e.g. fax, e-mail, etc.), without incurring any additional costs for the sender.

The maximum accepted declared value is 14000 RON.

WORLD MEDIATRANS S.R.L. provides the Cash on Delivery service, a postal service whose peculiarity consists in the payment by the addressee to the sender, through the postal network, of the value of the goods that are the subject of the registered postal item. These postal items shall be accepted only if the sender has correctly and completely indicated all his identification data. The admissible currency in which the collection and payment of the sums of money from the addressees is RON. The maximum amount accepted by the supplier is 5000 RON for legal entities and 10000 RON for individuals. The method of collection and payment of the reimbursement is in cash or by bank transfer. The deadline for returning the value of postal items to the sender (the amounts collected from the addressee) is 7 working days after delivery in the case of domestic postal items.

WORLD MEDIATRANS S.R.L. provides the Acknowledgement of Receipt service, a postal service which is characterized by the delivery to the sender of the proof of delivery of the registered postal item, confirmed in writing by the addressee. The deadline for return of the proof of delivery of the postal item, confirmed in writing by the addressee, to the sender shall be 5 working days after delivery for domestic postal items.

In the event of loss of the proof of receipt of the postal item by the addressee, WORLD MEDIATRANS S.R.L. shall draw up and provide the sender with a duplicate thereof.

The postal items shall be delivered to the address indicated by the sender, to the addressee’s mailbox, as the case may be, or personally to the addressee or to the person authorized to receive the postal item.

If it is impossible to deliver the postal items to the addressee (or the authorized person), WORLD MEDIATRANS S.R.L. will notify the addressee by a notice announcing the arrival of the postal item and will keep the postal item that could not be delivered to the addressee at the contact point for a period of 5 days from the date of the notice.

WORLD MEDIATRANS S.R.L. will return, at the sender’s address, at the sender’s expense (according to the rates indicated in the commercial offer), the registered postal item which could not be delivered to the addressee for one of the reasons provided by law, within 5 working days in the case of domestic postal items, and within 10 working days in the case of international postal items, the period being calculated, as the case may be, from the date of expiry of the period of retention as advised or of the attempted delivery.

WORLD MEDIATRANS S.R.L. shall be liable to the User in the event of failure to comply with the delivery times and return deadlines, as set out in this document, for all postal services.

WORLD MEDIATRANS S.R.L. will keep postal items that could not be delivered to the addressee nor returned to the sender for 9 months from the date of their deposit. Upon expiration of this period, unclaimed postal items shall become the property of WORLD MEDIATRANS S.R.L.

WORLD MEDIATRANS S.R.L. shall have the right to refuse to deliver the postal item to the addressee when, after the postal item has been taken over, it is beyond doubt that it contains goods that are prohibited for transportation or that do not comply with the special conditions of carriage established in accordance with the legislation in this field, namely the legislation of the countries on whose territory the delivery is to be made or of the countries to be transited, or when, after the postal item has been taken over, it has caused or may imminently cause damage to persons, the environment, the installations used or other postal items.

WORLD MEDIATRANS S.R.L. shall be liable, in case of loss, theft or total destruction, for domestic mail items, as follows:

1. for the full declared value, for a postal item that is subject to a declared value mailing service, including whether or not that postal item is subject to a reimbursement service;
2. with the reimbursement value, for a postal item which is the subject of a reimbursement service without declared value;

– In the event of total loss, theft or destruction, in addition to the abovementioned compensation, the charges levied at the time of deposit of the postal item shall be refunded.
– In the event of loss or partial destruction or damage, WORLD MEDIATRANS S.R.L. shall be liable for domestic mail items as follows:

3. with the declared value for the missing, destroyed or damaged part, entered in the inventory note, for postal items deposited open, which are subject to a declared value mailing service;
4. the amount of 10 times the tariff of the service, in the case of partial loss, partial destruction or damage of postal items not covered by a declared value mail item.

– In the case of an item subject to a reimbursement service, WORLD MEDIATRANS S.R.L. shall be liable for the full amount of the reimbursement if it has not returned the full amount to the sender or for the corresponding difference up to the full amount if the reimbursement has been partially collected from the addressee.

To the above amounts shall be added the statutory penalty interest running from the time when the preliminary complaint or, as the case may be, the request for a court action is lodged, whichever is the earlier.

Complete loss of the contents is equivalent to loss of the postal item.

Where the sender has declared a lower value than the actual value, the compensation shall be at the declared value.
In the event of non-performance of the services which constitute additional features of the postal services, nominated by the sender by means of special instructions, only the charges collected in addition to the applicable tariff for the standard postal service shall be refunded.

WORLD MEDIATRANS S.R.L. is exonerated from liability in the following situations:

– the damage occurred as a result of the sender’s or the addressee’s fault;
– the user does not have a mailbox installed that allows the postal item to be delivered or it does not ensure the security of the postal items or, as the case may be, – does not have a service for receiving postal items;
– the item has been received without objection by the addressee, except in the case of complaints relating to the loss, theft, damage or destruction of the contents of the postal item;
– the damage has occurred as a result of force majeure or unforeseeable circumstances; in this case the sender is entitled to a refund of the postage paid, except for the insurance charge.

Mechanism for settling complaints received from users

WORLD MEDIATRANS S.R.L. has established a mechanism for dealing with complaints, in particular regarding the loss, theft, partial or total destruction or damage of postal items, as well as failure to comply with the conditions of quality of service (terms of delivery, return, etc.).

The sender or addressee dissatisfied with the service provided may lodge a complaint within 6 months of the date of posting of the postal item.

The complaint of the user who considers himself/herself aggrieved/ dissatisfied must be made in writing and sent to the provider in one of the following ways: by personal delivery at the registered office or at the access/contact points manned by WORLD MEDIATRANS S.R.L. staff, by postal service (with return receipt recommended) to the address Bulevardul Cetatii nr 5-7-9, jud. Timis or by e-mail to cswmt@wmt.ro.

WORLD MEDIATRANS S.R.L. will register the received complaint in the Complaints Register and will confirm its receipt to the complainant in the same manner used for its submission by the user or in the manner requested by the user in the complaint, for example: by handing over the registration number in case the complaint was submitted in person, by signing the confirmation of receipt in case the complaint was received by a postal service with confirmation of receipt, by written address in case the complaint was received by a postal service without confirmation of receipt or by communicating the registration number by e-mail to the e-mail address from which the complaint was received.

In order to resolve the complaint, the complaining user must describe in the complaint he/she submits the event (facts, acts and causes) related to the complaint, state his/her claims, the method of payment chosen in the case of compensation and the information necessary for the transmission of the compensation (in case the complaint is found to be justified), attach to the complaint relevant evidence for a correct and complete analysis of the event complained of (such as, where appropriate, a copy of the document proving payment of the postal service, the invoice issued by the supplier, photographs, the packaging of the postal item, the damaged/damaged goods covered by the postal item, a copy of the report of the finding, etc. ) and to provide any other information that may be useful for the resolution of the complaint.

The representatives of WORLD MEDIATRANS S.R.L. will analyze the complaint received, taking into account both the evidence submitted by the complainant and the relevant information/evidence provided by their own employees or third parties involved, and may, where appropriate, even request an expert’s report.

The complaint will be solved (involving, complaint analysis, communication of the answer and granting of compensation) by WORLD MEDIATRANS S.R.L. within 3 months from the date of its submission.

In the case of complaints solved favorably, WORLD MEDIATRANS S.R.L. will compensate the user within 30 days from the date of the finalization of the analysis of the complaint, without exceeding, however, the above mentioned 3 months term, the payment of the amounts due to the user being granted, according to the request of the injured party, by postal money order, bank transfer or cash, from the cashier’s office located at the address Bulevardul Cetatii nr 5-7-9, Timis County

In case the complaint addressed to the postal service provider WORLD MEDIATRANS S.R.L. has not been satisfactorily resolved or has not been answered within the time limit provided for in these general terms and conditions for the provision of postal services, the user concerned may, within one year from the date of submission of the postal item, submit a complaint to the regulatory authority accompanied by proof of fulfillment of the prior complaint procedure or a request for legal action. The letter of formal notice may be submitted regardless of whether or not a complaint on the same subject has been submitted to the regulatory authority.

This document is an integral part of WORLD MEDIATRANS S.R.L.’s commercial offer, representing the general terms of the individual contract to be considered as concluded between the sender and WORLD MEDIATRANS S.R.L., at the moment of acceptance of the postal item in the postal network. The individual contract is concluded by the acceptance by the sender of the supplier’s offer, without the need to draw up a written document.
